Areas of practice:
| | A business and financial law practice concerned in both domestic and international disputes with particular specialisations in corporate insolvency law and reconstructions, in takeover litigation and professional negligence cases. His practice also includes a substantial amount of advisory work in relation to banking, securities, debt discounting and factoring, chattel leasing (especially Aircraft leasing), debt issues, securitisations (including in 1998 the Aurora securitisation) and general corporate law.
Reconstructions in which he was involved include the successful reconstruction of the Heron group of companies with simultaneous schemes of arrangement in England, the Netherlands and the Netherland Antilles, the proposed Ionica scheme and the Barings settlement and, more recently, Guandong Enterprises in Hong Kong and other Far Eastern and Russian reconstructions. For 12 years he was instructed in the litigation arising out of the receivership of the Gomba companies. |
Recent Cases:
| | He was instructed in the Bell litigation in Western Australia, and appeared for the banks in the satellite hearing in England: Bell Group Finance [1996] BCC. His more recent cases also include the dispute between Hambros and the liquidators of Galileo, the corporate vehicle of the failed bid for the Co-operative Wholesale Society [1998] 2 WLR. He appeared in Park Air Services [1997] 1 WLR CA disclaimer of a lease) and on the hearing in November 1998 of the appeal to the House of Lords in that case [1999] 2 WLR, and Mutual Reinsurance v KPMG (officers' indemnity) (1997) 1 Lloyd's Rep CA. He also appeared in the case concerning the exercise of administrators' powers prior to a creditors' meeting of T & D Industries plc [2000] 1 WLR. He has also been very heavily occupied in the complex fraudulent trading litigation brought by the liquidators of BCCI against Banque Arabe et Internationale d'Investissements: see the decisions of Neuberger J in the Times Law Reports on 23 December 1999 and New Law Online, 18 October 2000.
