Barry Mortimer
Barry Mortimer was Commissioned into 4 Royal Tank Regiment in Egypt after which he read law at Emmanuel College, Cambrdge. He was called to the Bar by Middle temple and is now a Bencher. After successful practice as a junior he took 'silk' when 39. An expert in Mining and Industrial Law he also practised widely in Commercial, Personal Injury, Criminal and Parliamentary law (the Methodist Church Bill and the Liverpool Street Station Bill included). He appeared as Leading Counsel in both Civil and Criminal Appeals in the House of Lords. In 1985 he was invited onto the High Court Bench in Hong Kong. There it fell to him to try many high profile Commercial, Insurance, Reinsurance, Banking, Company, Stock Exchange, Refugee/Immigration and Fraud actions. One notable banking case involved US$750 million. He was promoted to the Court of Appeal and later became a Vice-president of the Court of Appeal and a Non-Permanent Judge of the new Court of Final Appeal which replaced the Privy Council after 1997. He has retired as a Vice-president of the Court of Appeal but continues to sit as required in the Court of Final Appeal. His latest appointment in 2001 was to Chair the Environmental Impact Assessment Appeal Board to hear its first appeal concerning a HK$10 billion proposed new railway crossing into Mainland China. Barry Mortimer has a reputation as a sound, able and courteous judge of considerable experience. But he convinced of the great value of Mediation to resolve appropriate disputes. He notes its proven success when conducted by a trained and experienced mediator. He is a proponent of classical mediation procedure and he lectures on the subject. Recently he has completed a world lecture tour to the Antipodes, North America and the Continent on Hong Kong constitutional issues since the 1997 handover. He has lectured widely on legal subjects. He is a director of the City Disputes Panel which is sponsored by the Bank of England, the City of London, Lloyds and others. This provides Mediation and Arbitration services for the wholesale financial market in the City of London and Internationally. He is also on the arbitration panel of the Hong Kong International Arbitration Centre and a member of its Mediation group. Barry Mortimer has wide International experience. In 1994 he was made an Honorary Diplomate of the American Board of Trial Advocates for his services to the Board and in 1999 he was awarded the Gold Bauhinia Star for services to the Hong Kong Judiciary. He practices as a Mediator and Arbitrator from 3/4 South Square Chambers. |
