Recent major cases include acting for: the receivers of
Cheyne Finance (a SIV); creditor landlords with the benefit of guarantees
opposing a CVA (Powerhouse); opposing creditors at the hearing to convene
meetings for a scheme of arrangement for solvent insurers (the WFUM pool); Jarvis plc in connection with its financial
restructuring; creditors successfully opposing the sanction of a scheme of
arrangement for a solvent insurance company (BAIC); the trustee for noteholders
in opposing the issuer’s attempt to redeem the notes (involving the
interpretation of double taxation treaties) (Indofood); MyTravel plc in
connection with its financial restructuring; the administrators of Allders
Department Stores Ltd; the Bondholder Committee of Telewest in connection with
its financial restructuring; the Asbestos
Claimants Committee of Federal Mogul/ T & N Ltd; COLT in its successful
defence against proceedings brought by bondholders; the liquidators of BCCI
(since 1991); the administrators and liquidators of Barings; the Australian
liquidator of the Bond Group of companies; the former central bank of Cuba; the
purchasers of Global Crossing in connection with its restructuring; defending a
professional negligence claim on behalf of a firm of insolvency practitioners.
